Why is it that farmers may not be involuntarily petitioned into bankruptcy? (US law)?
I’m just curious, because it says that in my law book and I am wondering if there is any particular reason why or if it is because there is an overly effective farmers lobbying group?
BTW, I have nothing against farmers.
What a fine question. It goes back to the Frazier Lemke Act where lenders were always foreclosing on farmers. They had a special bankruptcy provision just for them. Farmers have historically had a strong legislative support. There’s even a special provision in the bankruptcy code called Chapter 12 specifically for the financial rehabilitation of family farmers.
