I WANT TO LAW SUIT MY SONS SCHOOL FOR NOT PUTTING MY SON’S PICTURE IN THE YEAR BOOK WHERE SHOULD I START?
IT WAS HIS SENIOR YEAR IT WAS A NEGLIGENCE BETWEEN THE PHOTO STUDIO AND YEAR BOOK SCHOOL COORDINATOR
Regardless what the other posters think, this IS important to the person . In matters of emotional distress we don’t neccessarily apply our OWN views of the damge. Foir instance some people would react to to being excluded from anything much differently than the next person. Being in a yearbook has been, for a hundred years, a symbol of community, fraternity, and achievement. An error like this seems to erase those “ideals”. I bet most lawyers would be more than miffed if they were totally left our of the alumni records; as if you don’t exist.
They need to make you whole. The need to be forced to print a reasonable number of yearbooks that include your sons photo, at their cost, for you to distribute to his friends and family; a couple of dozen. And replace the “official” one in the school archives.
While it maybe difficult for you to argue this case, pro se, in small claims court. I think you have the idea.
You should send a demand letter asking the relief I outlined.
Actually , thius is very interesting concept in a mistake and making a person “whole”; reminds me of other “occassion” suits: weddings, annivresearys, bar mitzvahs etc.
And maight make a good case in equity for a mediation such as Judge Judy or Peoples Court

EDIT: for those of you that don’t care if your photographer caught the moment after you paid him and depended on him/her…well. I guess there is little reason to commemorate any event. This is a contarct case, you realize. They didn’t fulfill their contract to photograph for the yearbook, create the yearbook, etc.
