Title issue/lawyer question?
I bought this car and paid half the money. We wrote a contract/bill of sale, that said, I pay the other half of the money within 30days when I pick the car up. 3 days later he sold the car to someone else. Is what he did even legal, because I got a copy of the Title and bill of sale written on the copy of the Title. Can I legally get the car back? How would I do this, civil court or criminal or contract law? This happened in Dallas, Texas.
A copy of the title is virtually worthless. Only a signed copy of the original title proves ownership. You never owned the car so there is no way to get it back. However, you can file a criminal complaint against the individual for fraud which could get him put in jail and you could also sue him in court, small claims court if you gave him less than $10,000. If he is convicted of the criminal charge unless the judge orders restitution as part of his sentence you won’t get your money back. If you sue in civil court and win you don’t actually get your money back either, you get a civil judgment against him which he might ignore. If he ignores the judgment you must go back to court an file a motion to enforce. If the motion is granted you can then legally seize any assets he has.
If you file charges or sue you might scare him into returning your money but my guess is that your money is gone because you’re probably dealing with someone who has no assets. If that’s the case you might get him put in jail, and you can ruin his credit if he has any, but that’s about it.
